PRIVACY POLICY

This Privacy Policy describes how Agra-Art SA uses information that is personal data within the meaning of the provisions of the Personal Data Protection Regulation (GDPR). You will also find information about your rights in connection with the processing of your personal data.
The Privacy Policy applies to all persons registered on the website belonging to Agra-Art SA operating under the domain and subdomain addresses: agraart.pl, and agraart.com.pl, as well as to all visitors to this website.
Protecting your data is our top priority. We want to assure you that we treat your data with due care and in compliance with the regulations on personal data protection.

§.1. General Provisions

  1. The data controller is Agra-Art SA with its registered office in Warsaw 00-679, ul. Wilcza 55/63, entered into the register of entrepreneurs under the KRS number: 0000101181, for which the registration files are kept by the District Court for the capital city of Warsaw, 12th Commercial Division of the National Court Register, NIP: 526-18-79-258, REGON: 012478229.
  2. The term "Service Provider" should be understood as the Administrator - Agra-Art SA
  3. For the purposes of better reception of the Privacy Policy, the term "User" means any person visiting the Administrator's website, as well as any person registered on the Agra-Art SA website, and has been replaced in some places with the term "You", and the term "Administrator" - with the term "We". The term "GDPR" means Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC.
  4. We respect the right to privacy and care about data security. For this purpose, we use, among others, a secure communication encryption protocol (SSL). Data protection is carried out in accordance with the requirements of generally applicable laws, and their storage takes place on secured servers and in places with controlled access.
  5. Personal data provided in forms are treated as confidential and are not visible to unauthorized persons.
  6. The data are not subject to automated decision-making, including profiling, as referred to in Article 22(1) and (4) of the GDPR.

§.2. Rights related to the processing of personal data

  1.   You have the following rights in connection with our processing of your personal data:

a) the right to access your data, including obtaining a copy of the data,
b) the right to rectify data
c) the right to delete data (in certain situations),
d) the right to lodge a complaint with the supervisory authority responsible for the protection of personal data,
e) the right to restrict data processing,
f) the right to object to the processing of personal data,
g) the right to transfer personal data; you can send this data to another data controller.

2. If your data is processed on the basis of consent, you may additionally exercise the right to withdraw consent to the extent that it is processed on this basis by sending a message to the address provided in paragraph 3 below. Withdrawal of consent does not affect the lawfulness of processing based on consent before its withdrawal.
3. In order to exercise the above rights, please contact the Administrator via the contact form or e-mail address agra@agraart.pl.
4. At the same time, we inform you that the withdrawal of consent does not affect the compliance of data processing carried out on the basis of consent before its withdrawal.
5. Providing data is voluntary, but necessary to use the Administrator's services.

§.3. Purposes and legal basis of data processing.

Data is processed:

a) to the extent and for the purpose consistent with the consent given by you, if you have subscribed to the newsletter – pursuant to Article 6 paragraph 1 letter a of the GDPR;
b) to the extent and for the purpose of admitting you to the auction (stationary, online or live) pursuant to Article 6 paragraph 1 letter b) of the GDPR;
to the extent and for the purpose of enabling the use of image evaluation and sale services via the website – pursuant to Article 6 paragraph 1 letter b) of the GDPR;
c) to the extent and for the purpose consistent with your consent, if you have expressed a wish to receive our publications in printed and electronic form – pursuant to Article 6 paragraph 1 letter a) of the GDPR;
d) for statistical purposes – analysing and profiling data for marketing purposes of the Administrator's services and products – pursuant to Article 6 paragraph 1 letter f) of the GDPR.
e) for the purposes of determining, pursuing or defending against claims directed against the Controller – pursuant to Article 6 paragraph 1 letter f) of the GDPR.

§4. Categories of data recipients

The Administrator has the right to transfer personal data to entities providing services to Agra-Art SA (in particular services such as IT system maintenance, accounting and legal services), as well as to entities authorized under the applicable legal provisions (e.g. law enforcement authorities, customs and tax authorities).

§5. Period of storing personal data

The deletion of personal data may occur as a result of the withdrawal of consent or objection to the processing of personal data.
Data may be stored for the time necessary to pursue and defend claims, taking into account the limitation periods applicable under applicable law.

§6. Cookies

1. The agraart.pl and agraart.com.pl websites use cookies. These are small text files sent by the www server and stored by the browser's computer software. When the browser reconnects to the site, the site recognizes the type of device the user is connecting from. The parameters allow only the server that created them to read the information contained in them. Cookies therefore facilitate the use of previously visited sites.
The information collected includes IP address, browser type, language, operating system type, Internet service provider, time and date information, location and information sent to the website via the contact form.
2. The collected data is used to monitor and check how users use our websites in order to improve the functioning of the service by ensuring more efficient and problem-free navigation.
Cookies identify the user, which allows the content of the website they are using to be tailored to their needs. By remembering their preferences, it enables the appropriate matching of advertisements directed to them. We use cookies to guarantee the highest standard of convenience of using our service, and the collected data is used only within Agra-Art SA to optimize operations.
3. Due to the lifetime of cookies and other similar technologies, we use two basic types of these files:
a) session files – temporary files stored on the User’s end device until logging out, leaving the website and application or turning off the software (web browser);
b) permanent – stored in the User’s end device for the time specified in the cookie file parameters or until they are deleted by the User.
4. Due to the purpose of cookies and other similar technologies, we use the following types:

a) “essential” cookies, enabling the use of services available on the website, e.g. authentication cookies used for services that require authentication on the website;
b) cookies used to ensure security, e.g. used to detect abuses in the scope of authentication within the website;
c) "performance" cookies, enabling the collection of information on how the website pages are used;
d) "functional" cookies, which enable "remembering" the settings selected by the user and personalising the user interface, e.g. in terms of the selected language or region the user comes from, font size, appearance of the website, etc.;
e) "advertising" cookies, which enable the provision of advertising content to users that is more tailored to their interests; Agra-Art SA cooperates in this respect with Google (Google Tag Manager managing Google Adwords tags) and Facebook (Facebook Pixel);
f) statistical – used to count statistics regarding websites and applications; in this respect we cooperate with Google, using Google Analytics; you can install a browser add-on that blocks this service (https://tools.google.com/dlpage/gaoptout).

5. Use of cookies

We use cookies and other similar technologies for the following purposes:
a) provision of services;
b) adapting the content of websites and applications to the User's preferences and optimizing the use of websites; e.g. cookies allow in particular to recognize the User's device and properly display the website tailored to their individual needs;
c) creating statistics that help understand how Users use websites and applications, which enables improving their structure and content;
d) maintaining the User's session (after logging in), thanks to which the User does not have to re-enter their login and password on every subpage of the website and application.
6. The user can disable or restore the option of collecting cookies at any time by changing the settings in the web browser. Cookie management instructions are available on the website

Additional personal data, such as e-mail address, are collected only in places where the user has expressly consented to this by completing a form. We retain and use the above data only for the needs necessary to perform a given function.
7. The entity that places information in the form of cookies and other similar technologies on the User's end device (e.g. computer, laptop, smartphone) and obtains access to them is Agra-Art SA and cooperating entities, including partners providing analytical services, application developers, network advertising agencies, in particular Facebook and Google.

§.7. Privacy Policy Updates

This Privacy Policy shall enter into force on February 22, 2021. Due to the needs that may arise from the development of the services we offer or regulatory changes, we are entitled to change the Privacy Policy. The new version of the Privacy Policy will be published on our website.
